Parinam is successful is setting aside an order passed by the Maharashtra State Co-operative Appellate Court, on the ground of non-compliance of Clause 660(4) of the Civil Manual, which prescribes the procedure to be followed by Courts upon withdrawal of appearance by the advocate for the parties.

Description

The case arises out of a money decree passed by the Maharashtra Co-operative Court, wherein the advocate for the clients withdrew his appearance. In Appeal, Maharashtra State Co-operative Appellate Court upheld the trial court decree and dismissed the Appeal. In a Writ Petition filed against the order of the Co-operative Appellate Court, the Hon’ble Bombay High Court was pleased to set aside the order of the Co-operative Appellate Court, on the ground that the clients were not provided an adequate opportunity to represent themselves in the trial court, as the trial court did not comply with the provisions of Clause 660(4) of the Civil Manual, while permitting the clients advocate to withdraw his appearance from the case before the trial court. The matter was remanded back to the Appellate Court, wherein Parinam was successful in arguing the Appeal and the matter is now remanded back to the Co-operative Court for a de-novo trial.
