BMC Circular For Online Process By The Estate Department – Parinam Law Associates

The Municipal Corporation of Greater Mumbai (“MCGM”) is the owner of various properties and estate in the city of Mumbai which have been granted on lease and / or are tenanted. All such estates belonging to the MCGM come under the jurisdiction of the Estate Department (“Estate Department”) of the MCGM.

As per the extant re-development policy, it is necessary for obtaining a no objection certificate (“NOC”) from the Estate Department prior to applying to the Building Proposals Department for obtaining the commencement certificate, occupation certificate etc. in respect of development of municipal leasehold and tenanted properties. Recently, with a view to promote ease of doing business, the Estate Department has introduced an online application system to obtain such NOCs. This system was given formal effect vide circular dated 26th July 2023 bearing no.AC/Estate/479378/AE(I) II issued by the Estate Department.

The activities for which such online application has been introduced are as follows:

For leasehold properties

  • Provisional NOC / Commencement Certificate up to plinth level under Ease of Doing Business (only for Plinth Level)

  • NOC for Commencement Certificate

  • NOC for Occupation Certificate

  • NOC for amendment of plans / FCC

  • NOC for amalgamation

For tenanted properties

  • Stage-I: Proposal Submission & Acceptance

  • Stage-II: Approval of Proposal under 33(7) / 33(9)

  • Stage-III: Issuance of Annexure-II (Inventory, Tenancy & Consent Verification)

  • Stage-IV: LOI (Technical Scrutiny, ICR/CR) (partially offline)

All other activities of the Estate Department shall continue as per the offline application system. Further, the applicants may still elect to submit their applications to the Estate Department using the conventional way until 15th September 2023, after which, only online applications will be accepted.

In our view, the introduction of the online application system is a significant move, which will help in reducing administrative operations, eliminating paperwork, and avoiding unnecessary delay as compared to the offline application system. This move is also a relief for the applicants as regards inter-departmental co-ordination between the Estate Department and the Building Proposals Department, in as much as, the single window online clearance system will ensure smooth transition and processing of the application across the departments.
