Parinam represented an author who was facing groundless threats of copyright infringement from the counter-party, who is also an author and who had filed an FIR against the client under the provisions of the copyright act. After securing an injunction against the making of such groundless threats before the trial court, the matter came up in Appeal before the Hon’ble Bombay High Court, wherein the Hon’ble Court was called upon to decide important questions of law interalia including ‘whether the filing of an FIR would be construed as an “action” under the proviso to Section 60 of the Copyright Act, thereby invalidating the clients legal remedy under Section 60 of the copyright act’. The case makes an effective and valuable contribution to the jurisprudence surrounding Section 60 of the Copyright Act.
